Agreement:

In signing and submitting this document the applicant, as named above, agrees to the following terms, ongoing whilst a member of 99.9 Voice FM unless and until it is replaced by a revised

Agreement:

1. To apply to be admitted as a member of the Ballarat Community FM Radio Co-Operative Limited and be allotted 5 (Five) shares therein. In Respect to such application, the applicant will lodge herewith in accordance with the Rules, the sum of $10.00 (Ten dollars), which sum is made up as shown hereunder.

2. If this application be approved and the shares as aforesaid be allotted to the applicant, I agree to pay all the charges required by the Co-Operative, a list of which have been supplied to the applicant.

3. The applicant agrees to abide by the Rules of the Co-Operative, and by any amendments there of registered in accordance with the Co-Operatives National Law Application Act 2013.

4. The applicant has been advised they may view at the registered office of the Co-Operative, a copy of the Rules and the last Annual Report of the Co-operative, as outlined under Section 249 of the Act.

5. The applicant is least the age of 18 (eighteen) years. If under the the age of 18 (eighteen) years the applicant is to have completed and signed the document in the presence, and with the approval of a legal guardian.

6. The applicant has not held a previous membership with the station. If the applicant has held a previous membership with the station, this has been disclosed in the above form.

7. All applicants are required to become members of the Station. All Presenters must be fully paid members to present or assist with on-air programs.

8. All applicants must be able to obtain or have a Working with Children Check, and be able to provide it within 90 days of signing this agreement.

9. The Station undertakes to provide facilities, training, infrastructure and a safe working environment that enable the members to work in a community radio station.

10. The applicant undertakes to complete any training as required by the CBAA or station management, as directed by the training coordinator.

11. The applicant undertakes to accept all directions and decisions made by the Board/Management concerning – program content, technical quality, presentation skills and on-air conduct, access to Station premises, use of Station equipment and property, strategic planning, risk management and Occupational Health and Safety.

12. Members, and their guests where applicable, will not enter any studio in which another Presenter is conducting their show, without an invitation.

13. The Station undertakes to give members access to the Station’s conflict resolution processes as set out in the Community Radio Broadcasting's Codes of Practice. Concerns presented in writing will be addressed at the next scheduled Management Meeting or referred onto the next Board Meeting, if so required.

14. The applicant undertakes to treat other volunteers, guests of the Station, and the Board with consideration and respect and will not discriminate based on race, religion, age or sex.

15. The applicant undertakes to take full responsibility for the safety, security and proper use of any key(s) / swipe card(s), or other property which is made available to them and to promptly return any such item(s) in good condition to the Station immediately on the expiry of this Agreement. Damage is to be reported immediately to Management.

16. The applicant undertakes not to remove Station equipment or property including media and records. This includes copying music files from the Station computers or using Station equipment to burn CD’s for personal use. This is illegal under the Copyright Act.

17. The Station undertakes to provide Station equipment and facilities for the production, preparation and presentation of programs. Station equipment may not be used for any other purpose without the prior consent of Management. Computers can only be used for program research, on-air presenting, training purposes, or other station business.

18. The applicant undertakes to not make commercial / promotional representations on behalf of 99.9 Voice FM, to any person or organisation without prior authority from Management.

19. The Applicant undertakes to conduct their work for the Station in the spirit of its Mission Statement, Rules and Policies and Procedures.

20. The applicant undertakes to fully and accurately complete and sign their log sheet, including any guests who fall under the applicant’s responsibility.

21. The applicant acknowledges their personal property, and property of any guests, are the sole responsibility of the individual. 99.9 Voice.FM accepts no responsibility for lost, stolen or damaged property.

22. The Station undertakes that it will take every care with recorded material left by the Presenter at the station but cannot accept any responsibility for loss or damage.

23. The applicant undertakes to check the diary, notice board, the whiteboard and for personal notices in their pigeonhole on arrival at the Station.

24. The applicant undertakes to assist with additional tasks, when appropriate.

25. In relation to the transmission of their program the Presenter undertakes:

25.1. To accept responsibility for the content of their program, and so far as it is possible to do so, agrees to comply with the laws relating to defamation, libel and slander, obscenity and contempt of court.

25.2. to comply with the requirements of the Community Broadcasting Code of Practice and the Broadcasting Services Act 1992 and any other applicable legislation, and accept all liability attached to the Station caused by their breach of such Code or Act.

25.3. To be at the Station premises, ready to present their program at the scheduled time.

25.4. To remain on the premises and in control of their program for its full duration;

25.5. To provide a replacement Presenter, if required, and approved by Management or provide a pre-recorded program (in the event they cannot do their program) at least twenty-four (24) hours before broadcast time, if possible;

25.6. To notify the CEO (if not available) then a Management member by telephone or in person at least twenty-four (24) hours (a longer time is preferable) before broadcast time if unable to present their program on a particular day (except in an extreme emergency);

25.7. To adhere to the 25% Australian music requirement as set out by the CBAA, unless a prior agreement with the CEO has been made.

25.8. to broadcast sponsorship and community announcements, health, police, CFA, SES messages and other logged items as listed on the Station log sheet during their program;

25.9. To ensure that any guests they have on their program do not operate any broadcasting equipment (including all computers etc.) and to take full and sole responsibility for the correct and appropriate behavior and activities of those guests whilst they remain on the Station premises;

25.10. To refrain from openly criticising on-air: 99.9 Voice FM, the Board, Management and other members.

Note: There are appropriate internal avenues for addressing concerns.

25.11. To comply with any reasonable request by Management to change their broadcast time, the day, program content or length if special circumstances arise. 99.9 Voice FM shall at all times retain the right to control and formulate the structure and timing of programs.

25.12. To understand that their program is the property of the Station. Such programs may only be sold and / or broadcast by other outlets with the permission of Management.

25.13. To understand that the Board and / or Management has the right to remove the program from air if it fails to comply with Station rules, policies, guidelines, governing principles, management directions, statutory requirements or if the presentation skills, on-air manner / behavior and Station etiquette are not of a standard acceptable to the Board / Management.

25.14. If a new Presenter, they undertake to understand that they will be on-air on a trial basis for a Probationary Period lasting up to three (3) months. Their progress will be reviewed and evaluated during this period and subject to satisfactory performance they may then be offered a permanent appointment as a Presenter.

Note 1: A Presenter can be taken off-air if performance is not satisfactory during the probationary period

Note 2: If no time slot is available the Presenter will go on a waiting list or possibly share a slot with another Presenter until a mutually acceptable time becomes available.

25.15. To understand that the Board and / or Management can initiate an Evaluation of the quality of their program and presenting skills to assess satisfactory performance and to suggest improvements as required. If they refuse to do the evaluation, the Board / Management has the right to suspend or dismiss them for lack of co-operation for a period of its choosing. Reinstatement is at the discretion of the Board / Management.

25.16. to not use offensive language at any time, but may broadcast some explicit material after hours and with an appropriate disclaimer and prior approval.

25.17. to attend 99.9 Voice FM’s Presenter Meetings; as arranged.
